BEBT attorneys win summary judgment in favor of excess insurer in third-party bad faith lawsuit
Plaintiff brought claims for violations of Montana’s Unfair Trade Practices Act and in common law bad faith, arising out of the settlement of her underlying claim for sexual assault. BEBT attorneys John Bohyer and Ryan Heuwinkle, representing the excess insurer, filed a Motion for Summary Judgment. The Montana District Court granted BEBT’s motion, finding there was no bad faith and dismissing the excess insurer from the suit.
